Summary:

The Manager Risk Management manages risk management and loss prevention programs in order to maintain maximum protection of the organization’s assets at the most economical rates. Investigates and reports on accidents involving products, and coordinates follow-up with insurance companies and attorneys. Reviews and analyzes data and devices risk minimization programs and market requirements involving organization products.

Responsibilities:

  • Demonstrates knowledge of the CHRISTUS Health's insurance coverage for liability and casualty loss, including self-insurance funding and budgeting for payment of deductibles, risk retention and coinsurance.
  • Participates in management reviews of insurance coverage, completes insurance applications, reviews insurance files, responds to insurance related surveys/requests by outside agencies and may prepare summaries of the region’s insurance program for information of management staff and CSHS Board of Directors.
  • Gives input as requested to the process of negotiating coverage issues with carriers or trust administrators, including levels of coverage, scope of coverage and premiums, and in formulating recommendations for purchase of coverage (or funding of self-insurance) for submission to management for final approval.
  • As applicable at the local level, reviews, verifies coverage, maintains and securely stores insurance policies. Anticipates and deals with policy expirations in a timely manner.
  • May assess appropriate reserve funding levels, both insured and self-insured, in conjunction with the Risk Management Department of CHRISTUS Health, a professional actuary and CSHS’s Chief Financial Officer (or designee).
  • Responds to professional and general hospital liability questions posed by CSHCC physicians, nurses and other personnel.
  • Designs, implements and maintains a direct reporting system for hospital staff, physicians and visitors to report unusual occurrences, accidents, medical errors and equipment issues.
  • Receives, reviews and maintains all CSHCC incident reports in a secure and confidential manner.
  • Directs or assists with the investigation of incidents and provides recommendations/corrective action as appropriate.
  • Collates data received via incident reports, intradepartmental problem sheets, verbal reports, etc., and inputs in CSHCC’s Risk Management Database.
  • Identifies trends, prepares reports for management and works with staff to decrease potential risk in identified areas of concern.
  • Assesses incidents and events which may evolve into a liability claim and proceeds as appropriate.
  • Directly refers to administration and CHRISTUS Health Risk Management Department those incidents with claims potential. Reports to Regional Chief Medical Officer and facility administrator any serious event involving actual or potential injury to patients, visitors or employees. (TJC defined “Sentinel Event” occurrences shall be immediately reported per CHRISTUS Health policy.
  • Works directly with CSHCC’S legal counsel, and CHRISTUS Health Risk Management Department as a team member in the defense of claims.
  • Receives complaints and claims related to professional liability and transmits that information to the CHRISTUS Health Risk Management Department.
  • Participates as a team member in negotiating settlements for management approval. In litigated claims, assists legal counsel in accessing facility records and personnel and may act as a corporate representative during pretrial and trial.
  • Participates in evaluating claims appropriate for settlement. Negotiates settlement of small claims within administrative authority. Advises CSHS’s Business Office of appropriate action regarding patient accounts involved in claims or litigation. Approves payment for (or replacement of) lost property after evaluating claims.
  • Provides advice and information to CSHS’s Regional Chief Medical Officer regarding reasonableness of outside expenses for claims defense.
  • Evaluates correspondence from attorneys, patients, and/or the outside sources and formulates responses as necessary.
  • Records, collects, documents, maintains and communicates to CHRISTUS Health Risk Management Department and/or hospital attorney any information necessary to prepare testimony in pending litigation.
  • Maintains all legal case files and ensures maximum protection from discoverability of all such files.
  • In consultation with CSHS’s Regional Chief Medical Officer and CHRISTUS Health Risk Management Department, participates in the development defense postures or settlement values.
  • Answers medicolegal inquiries from physicians, nurses and administrators regarding emergent patient care issues and loss control.
  • Is available to resolve treatment issues, including patient refusal of treatment, consent issues, and issues involving AMA’s (Against Medical Advice).
  • Facilitates court orders as appropriate via in-house and/or outside legal counsel.
  • Manages the Office of Risk Management.
  • Is responsible for data management, claims management, and the education components of the facility’s risk management program.
  • Develops departmental budget for management approval.
  • Directs loss control/loss prevention activities.
  • Supervises the statistical trending of losses and analyzes patterns.
  • Designs and implements risk management surveys and studies. Conducts surveys, studies and special projects to assist in long-term planning and changes to hospital policies and systems that will reduce risks and losses.
  • Supervises accumulation of risk management cost data for budgetary and historical.
  • Ensures confidentiality of and controls access to risk management information.
  • Informs directors of service and department heads regarding occurrences, issues, findings and risk management suggestions.
  • Provides feedback to associates at all levels in an effort to eliminate and reduce risks. Assists Medical Staff clinical chairman, and department heads in designing risk management programs within their departments.
  • May assume “on call” responsibility.
  • Oversight of Risk and Safety Alert Management System (RASMAS) and Fleet Safety Program.
  • Develops and implements educational programs to reduce (or eliminate) potential safety hazards.
